92 이와 같은 제도들은 종종 비민주적인 것으로서 비판된다.  왜냐하면 그것들은 예를 들어 판사들의 소규모 위원회에 시민 대다수가 표명한 의사를 물리칠 권리를 부여하고 있기 때문이다. 
51 Arrangements such as this are often criticized as undemocratic, because they give a small committee of judges, for instance, the right to block the expressed will of the majority of citizens. 

이것을 옹호할 수 있는 방법이 하나 있다. 이것이 헌법에 들어맞는가 들어맞지 않는가를 판사들이 판단한다는 것이다. 그렇지만 판사들이 법을 새로 만드는 것이 아니니까 그것을 용인할 수 있다는 것이다. 

93 그러나 헌법 자체가 민주적 절차에 의해 채택되는 사례를 상상하기는[채택된다는 것을 생각하는 것은] 어렵지 않으며, 현실 세계의[실제로 제정된] 헌법은 대개 수정을 위한 조항을 마련하고 있고[수정할 수 있게 되어있고], 수정이 통과될 수 있으려면 보통 유권자의 단순 과반수 이상의 지지[찬성] 투표가 필요하다.  
51 But it is not difficult to envisage the constitution itself being adopted by a democratic procedure, and most real-world constitutions make provision for amendment, usually requiring more than just a simple majority of voters to support an amendment if it is to pass. 

93 그렇다면 왜 사람들은 장차 자신들이 다수결을 행사할 수 있는 권한을 제한하는 헌법에 찬성 투표를 할까? 
51 Why would people vote for a constitution that restricted their power to make majority decisions in future?

93 그들이 그렇게 하는 것은 당연하다. 왜냐하면 사람들은 자신의 권리 가운데 특정한[일정한, 어떤] 것이 보장되기를 원할 것이고, 자신들이 향후 인기 없는[지지를 얻지못하는] 소수자의 일부가 되지 않으리라는 확증이 없기 때문이다.  
51 They might well do so because they wanted certain of their rights protected, and could not be sure that they might not find themselves as part of an unpopular minority. 

93 종교의 자유를 예로 들어보자. 종교적 신념을 지닌 사람은 누구나 자신이 믿는 특정한 종교에 대해 사회의 다수자가 강하게 반대할지라도 자신의 종교를 안심하고 실천할 수 있기를 보장받고자 한다.  
51 Take religious freedom as an example. Anyone with religious beliefs wants to be sure that she can practise her religion safely, even if the majority in her society is strongly opposed to the particular religion she believes in. 

93 소수자들을 보호하기 위한 또다른 헌법적 장치는 일군의 서로 다른 쟁점들을 결정할 수 있는 분리된 선거구들을 신설하는 것이다.  
51 Another constitutional device to protect minorities is to create separate constituencies to decide different sets of issues. 

95 그래서 헌법상의 장치는 소수자가 다수자에 의해[다수자 멋대로 하는 것에] 고통당하지 않도록 보장하는 중요한 방법임에도 불구하고, 모든 시민을 평등하게 처우할 것을 목표로 하는 민주주의 체제는 더 멀리 나아가야만 한다.  
52 So although constitutional devices are an important way of ensuring that minorities do not suffer at the hands of the majority, a democratic system that aims to treat every citizen equally has to go further. 

at the hands of the majority의 번역이 누락되어 있다.

democracy민주정. 의사결정 체계를 가리키는 말. 그것의 내용에 관계없이 어떤 것을 목표로 할 때 어떤 식으로 결정할 것인가. 나쁜 짓을 할 때도 이 방법을 채택할 수 있다.  
democraticism 민주주의. 목표와 내용이 잇다. 모든 시민을 평등하게 처우한다to treat every citizen equally. 민주주의는 평등을 목표로 하고 있다. 공정한 사회가 아니라 평등한 사회이다. 공정은 상대적인 개념이다. 평등을 실현하기 위해서 공정한 방법을 사용할 수 있다. 

95 그러한 체제는 기본권이 문제가 아닌 경우 들에서도 다수자가 최종적인 결정에 이르기 전에 소수자의 관심을 적절히 고려할 수 있도록 보장하려고 해야 한다.  
52 It has to try to ensure that the majority takes the concerns of the minority properly into account before reaching a final decision, even in cases where basic rights are not at issue. 

96 민주주의는 요구하는 바가 많은 까다로운 일이라는 것이 판명된다.
96 Democracy, it turns out, is a demanding business.
